Frequently asked questions

Regulator Portal FAQ

What is ChowIndex Regulator Portal?

ChowIndex Regulator Portal is a read-only, audit-grade monitoring platform for state and federal regulatory agencies overseeing hemp-derived cannabinoid commerce — Delta-8, Delta-9 hemp, Delta-10, HHC, THC-O, THCP, THCV, THCA flower, synthetic cannabinoids, and the broader intoxicating-hemp marketplace. You see every registered seller, every product they list, every COA they publish, every lab refute, every recall, and every financial backer (bank, processor, insurer) who has opted in to regulator visibility.

Which agencies use ChowIndex?

State Departments of Health, State Departments of Agriculture, State Departments of Revenue, State ABC commissions, Attorneys General offices, State Bureaus of Cannabis Control, U.S. Food and Drug Administration (FDA) monitoring teams, U.S. Department of Agriculture (USDA) hemp program staff, Drug Enforcement Administration (DEA) intelligence units, Federal Trade Commission (FTC) consumer protection, Consumer Product Safety Commission (CPSC), and state Poison Control surveillance offices.

How much does it cost?

The State Tier is $4,999 per state per month — purchase one state (e.g. Texas) or any combination. The Federal Tier is $14,999 per month flat and grants visibility into all 50 states + the District of Columbia. The Federal Tier is monitoring-only and does not generate ad-hoc alerts (per agency request), while the State Tier includes the full alert and digest stack.

Is this read-only? Can we take enforcement actions through the platform?

ChowIndex Regulator Portal is intentionally read-only. We do not initiate enforcement, send cease-and-desist letters, or modify private merchant data. We provide audit-grade visibility and timestamped evidence packs that your agency can use to substantiate its own enforcement actions through its own legal authority and channels.

What alerts does the State Tier include?

State-tier subscribers receive:

(1) Immediate alerts when an accredited lab refutes or flags-forged a COA on a product sold in your state.
(2) Daily 8:00 AM scan alerts for sellers in your jurisdiction whose public risk score crosses your configured threshold (default 50/100).
(3) Immediate alerts when a new seller registers business operations in your state.
(4) Immediate alerts when a product sold in your state is flagged non-compliant against any active state-law expression you've subscribed to.
(5) A weekly compliance digest delivered Sunday 9:00 AM summarizing all activity.

Why no alerts on the Federal Tier?

Federal agencies typically run their own intake, triage, and case-management systems and have explicitly requested a pure monitoring footprint without inbound alert noise. The Federal Tier provides the full read-only data surface — every seller, COA, refute, lab, and controller-disclosed financial backer across all 50 states + DC — but does not push event notifications. Federal subscribers receive only the welcome email at sign-up.

How do you know which sellers are "in our state"?

ChowIndex assigns each seller a primary business state (from their registration), and tracks their SKU-level distribution footprint by state (from shipping data, retailer reports, and merchant disclosures). The State Tier scope follows the seller's business_state field, ensuring you only see sellers operationally based in your jurisdiction.

Can we see which banks and payment processors are backing each seller?

Yes — but only where the controller (bank, processor, or insurer) has opted in to regulator visibility. By default, controller relationships are hidden. Controllers may opt in via a one-click toggle in their portal settings, typically as part of an insurance partnership, voluntary disclosure agreement, or proactive regulatory engagement.

How does ChowIndex differ from Metrc, BioTrack or LeafLink for regulators?

Metrc, BioTrack and similar state track-and-trace systems are the source of truth for state-licensed adult-use and medical cannabis programs operating inside one state's regulated market. ChowIndex is the complementary visibility layer for the federally legal but state-variable intoxicating-hemp market that operates interstate via e-commerce and is NOT in your state's track-and-trace system. We do not replace Metrc — we show you the part of the cannabinoid market Metrc cannot see.

Is the platform secure and audit-compliant?

Yes. All regulator data is encrypted in transit (TLS 1.2+) and at rest (AES-256). Access is single-factor by default with optional MFA. Every page view, every export, and every search is logged in an immutable audit trail. We sign DPAs and provide annual SOC-2 Type II reports under NDA. All data is stored in AWS us-east-1; FedRAMP Moderate-equivalent controls are available on request.

How do we sign up? Can we be invoiced?

Create your account using your agency email address (typically a .gov or state-level domain). After verification, select your tier (State or Federal) and either pay by card via Stripe or request a Net-30 invoice for ACH / wire / purchase-order procurement. Agency POs are accepted; we issue W-9 and standard government vendor packets on request.

What does a "state-law expression" mean in the alerts?

A state-law expression is a structured rule capturing a specific compliance requirement in your state — for example, "Δ8-THC products are prohibited in Colorado", or "THCA flower over 0.3% post-decarb Δ9-THC violates Texas HB 1325". ChowIndex maintains a registry of active state expressions for all 50 states, and you can subscribe to any subset for non-compliance alerts.

Hemp, THCA & intoxicating-hemp compliance monitoring built for regulators

The 2018 Farm Bill federally legalized hemp containing less than 0.3% Δ9-THC by dry weight, but it created a market that traditional state cannabis regulators, federal drug-enforcement agencies, and consumer-product safety bodies were never resourced to monitor. Today, a typical state agency must track thousands of intoxicating-hemp brands — Delta-8 gummies, Delta-9 hemp beverages, HHC vape carts, THCA flower, THC-O tinctures, THCP edibles, synthetic-cannabinoid blends — that ship into the state by e-commerce, operate under federal hemp authority, and are not in any state track-and-trace system. Enforcement is reactive: a complaint comes in, a product is tested, a cease-and-desist is drafted, and by the time it's served the operator has switched DBAs and re-launched.

ChowIndex Regulator Portal closes that gap. We give state and federal agencies a live, audit-grade view of the entire intoxicating-hemp market in their jurisdiction — every seller, every SKU, every Certificate of Analysis, every accredited-lab refute, every recall, and every voluntarily disclosed financial backer. State-Tier subscribers receive immediate alerts on COA refutes, daily risk-threshold scans, new-seller jurisdiction notifications, non-compliant product alerts, and a weekly compliance digest. Federal-Tier subscribers receive the full nationwide data surface in pure monitoring mode.

What this enables for your agency

  • Proactive enforcement targeting — instead of waiting for complaints, identify the highest-risk sellers in your state and prioritize investigations by objective public risk score.
  • Audit-grade evidence packs — one-click PDF + CSV bundles per seller, timestamped and immutable, drop-in to cease-and-desist files, AVCs, or court submissions.
  • Cross-state pattern detection — surface the same operator running multiple DBAs across states under different brand names.
  • Lab-forgery intelligence — detect labs whose name is being repeatedly forged and coordinate with the lab's accrediting body.
  • Financial-flow visibility — where banks, payment processors, and insurers have opted in to regulator visibility, see who is underwriting the highest-risk sellers.
  • Synthetic-cannabinoid early warning — track emerging analogs (THC-O, THCP, semi-synthetic blends) before they reach widespread distribution.

Built for the 2026 hemp regulatory environment

State legislatures across the country are passing — and revising — intoxicating-hemp legislation at a rate no static compliance manual can keep pace with. ChowIndex maintains a live registry of state-law expressions for all 50 states, updated as new statutes are signed, regulations are promulgated, or AG opinions are issued. Subscribe an expression and any product in your jurisdiction that violates it triggers an alert in your queue.

Whether you are a state Health Department tracking Δ8-THC adverse events, an Attorney General building a multi-DBA consumer-protection case, an FDA monitoring team scanning for warning-letter candidates, a USDA hemp program officer auditing producer-to-product flow, or a DEA intelligence unit watching for emerging analogs — ChowIndex Regulator Portal gives you a single, defensible source of truth for the federally legal but state-variable intoxicating-hemp market. Create your agency account above to begin.
