The Hemp Ban, Explained
There is no single bill called “the hemp ban”. What changed is the federal definition of compliant hemp — and one number inside that definition does nearly all the work.

Intoxicating hemp products are typically sold at 5–10 mg of THC per piece. A per-serving ceiling roughly ten times lower removes that whole category from the federal definition of hemp, however the plant itself tested.

The 2018 test measured Delta-9 THC only. The current test measures Total THC, which counts THCA once it converts. That single change is why THCA is the cannabinoid most affected.
Why THCA is at the centre of it
THCA is not intoxicating in its raw form and it is not Delta-9 THC. Under a Delta-9-only test, THCA flower could be laboratory-compliant while still producing Delta-9 the moment it was heated. Total THC counts the THCA that would convert, using a 0.877 factor, so flower that passed before now fails.

Practically: read Total THC on the certificate of analysis, not Delta-9 alone. A product can show a compliant Delta-9 figure and a non-compliant Total THC figure, and it is the second number the current federal definition turns on.
Then check the batch number on that certificate against the packaging. A lab report that cannot be matched to the batch in your hand tells you nothing about it.

What is the 2026 hemp ban?
It is not a single bill banning hemp. The federal definition of compliant hemp was rewritten around a dual test: Total THC of no more than 0.3% by dry weight AND no more than 0.4 mg of Total THC per serving. The per-serving figure is the operative change, because most intoxicating hemp products are sold well above it.
When does the hemp ban start?
Implementation dates have moved more than once, and state law is running on its own timetable regardless. Rather than quote a date that may already have shifted, we maintain a live per-state index and update it as statutes change.
Does the hemp ban make THCA illegal?
It closes the gap THCA relied on. The 2018 Farm Bill measured Delta-9 THC only, so THCA flower could test compliant while still converting to Delta-9 when heated. A Total THC standard counts the THCA that would convert, so the same flower no longer passes.
Is Delta-8 banned everywhere?
No. Across the 51 jurisdictions we track, Delta-8 is banned in 30, restricted in 8, explicitly legal in 6, and not named in statute in 7. State law is independent of the federal definition.
What does 0.4 mg of Total THC per serving actually mean?
It is a per-dose ceiling rather than a percentage of plant material. A typical intoxicating hemp gummy is sold at 5 mg to 10 mg per piece, so a 0.4 mg limit sits roughly an order of magnitude below the products currently on shelves.
