1. Compliance Tools Provided

Chow420 publishes a set of free, informational compliance tools (collectively, the “Compliance Tools”) on its websites and applications, including, without limitation: (a) the home-page End-to-End Hemp Compliance section and 50-state interactive calculator; (b) the per-product Compliance Calculator displayed on each product detail page; (c) the 21+ age gate notice; (d) the 2018 Farm Bill federal-compliance indicator; (e) per-state hemp law pages located at /hempstatelaws; and (f) any related badges, status pills, or verdicts (“Allowed,” “Restricted,” “Verify locally,” or similar). The Compliance Tools are powered in part by ChowIndex, an independent transparency index for lab-tested hemp products.

2. Informational Only — Not Legal Advice

The Compliance Tools are provided for general informational purposes only and do not constitute legal, medical, tax, regulatory, or professional advice of any kind. Hemp and cannabinoid law in the United States changes frequently and varies by federal, state, county, and municipal jurisdiction. 3. Buyer’s Affirmative Duty of Due Diligence

You — the buyer — bear sole and exclusive responsibility for determining whether any product you purchase through Chow420 is legal for you to buy, possess, ship, and use in your delivery jurisdiction. Before placing an order, you must:

  1. Select your accurate delivery state in the on-page compliance calculator;

  3. Cross-reference the linked state hemp law page for the current statute, threshold, and effective date;
  4. Independently confirm the rule with your state Department of Agriculture, Department of Health, Attorney General’s office, or qualified legal counsel; and
  5. Confirm you are at least 21 years of age and lawfully permitted to receive the product at your shipping address.

By placing any order, you represent and warrant that you have completed each of the foregoing steps and that the order is, to the best of your knowledge after such due diligence, lawful in your jurisdiction.

4. “Restricted” Verdicts — No Waiver

If a Compliance Tool returns a “Restricted,” “Fail,” or “Verify locally” verdict for your selected delivery state, you proceed at your own risk. Chow420’s decision to accept or process the resulting order does not constitute legal approval, an opinion of counsel, a waiver of state law, or a representation that the product is lawful for you. You assume all risk of seizure, fines, forfeiture, civil penalty, criminal exposure, and any other consequence arising from the shipment, possession, or use of any such product.

5. Data Sources & ChowIndex

The Compliance Tools rely on (i) state statutes, regulations, and guidance published by state agencies; (ii) Certificate-of-Analysis (COA) data submitted by third-party manufacturers and lab partners; and (iii) data feeds provided by ChowIndex. Chow420 does not independently audit, certify, or warrant any of this third-party data. To the maximum extent permitted by law, Chow420 disclaims all liability for inaccuracies, omissions, errors, delays, stale data, or misclassifications in the Compliance Tools.

6. Tool Outputs Are Not Promises of Service

An “Allowed” or “Pass” verdict is a snapshot in time and is not a guarantee that (a) the product will continue to be lawful in your state through delivery, (b) the carrier will deliver to your address, (c) the order will not be intercepted, returned, or seized by any state, federal, or local authority, or (d) you will not face questioning at delivery. Laws may change between the time the Compliance Tool was last reviewed (as displayed on each tool) and the time your order ships or arrives.

7. Universal 21+ Age Restriction

All Chow420 accounts and all checkouts are gated to adults 21 years of age or older, regardless of any lower minimum age permitted by your state. You must present a valid government-issued photo ID at delivery for age-restricted items. Misrepresentation of age is a material breach of these Terms and grounds for immediate account termination without refund.

8. Expanded Indemnification

In addition to any other indemnity in these Terms, you agree to defend, indemnify, and hold harmless Chow420, ChowIndex, their affiliates, officers, directors, employees, agents, vendors, and lab partners from and against any and all claims, demands, actions, losses, liabilities, damages, fines, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your failure to perform the due-diligence steps in Section 3; (b) your decision to place an order in the face of a “Restricted,” “Fail,” or “Verify locally” verdict; (c) any change in applicable law between order placement and delivery; (d) any inaccuracy or omission in third-party data, including but not limited to COAs and ChowIndex feeds; (e) any seizure, fine, forfeiture, or enforcement action against you or your shipment; and (f) any misrepresentation by you of your age, identity, address, or delivery jurisdiction.

9. Limitation of Liability — Compliance Tools

To the fullest extent permitted by law, Chow420’s and ChowIndex’s aggregate liability arising out of or relating to the Compliance Tools is limited to the amount you paid for the specific product the verdict concerned, or US$50, whichever is less. In no event shall Chow420 or ChowIndex be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages of any kind — including lost profits, lost data, criminal-defense costs, regulatory penalties, business interruption, or reputational harm — arising from your use of, reliance on, or inability to use the Compliance Tools, even if advised of the possibility of such damages.

10. AS-IS / AS-AVAILABLE

The Compliance Tools are provided “AS IS,” “AS AVAILABLE,” and “WITH ALL FAULTS,” without warranty of any kind, whether express, implied, statutory, or otherwise — including, without limitation, warranties of merchantability, fitness for a particular purpose, accuracy, currency, non-infringement, or that the tools will be uninterrupted, error-free, or free of harmful components.

11. Order of Precedence

In the event of any conflict between this Compliance Tools Addendum and the body of the Terms above, this Addendum controls with respect to the Compliance Tools and the buyer-due-diligence duties described herein.

Marketplace Role, Direct Fulfillment & Federal Compliance Addendum

Addendum effective: 05 Aug 2026. This addendum is incorporated into and made a part of these Terms.

1. Marketplace Intermediary; Chow420 Is Not the Manufacturer

Chow420 operates exclusively as an online marketplace and technology intermediary. Chow420 does not manufacture, produce, formulate, compound, process, package, label, test, or alter any product listed for sale on the Site. Every product offered on the Site is manufactured, packaged, and labeled by an independent third-party manufacturer or brand (each, a “Manufacturer”), and it is the Manufacturer — the entity that actually makes the product — that is solely and exclusively responsible and liable for that product. Even if Chow420 is characterized as a seller, retailer, or point of sale because products are purchased through the Site, Chow420 is not, and shall not be deemed, the manufacturer, producer, formulator, importer, or fabricator of any product for purposes of any product liability, consumer-protection, or similar law, and all manufacturer-level liability remains with the Manufacturer.

2. Direct Fulfillment (Drop-Ship) Model

All orders placed through the Site are fulfilled and shipped directly by the Manufacturer (or the Manufacturer’s designated fulfillment partner) to the buyer. Chow420 does not, at any point, take physical possession of, store, warehouse, handle, inspect, package, or ship any product. Chow420 owns and operates no warehouse, fulfillment center, or storage facility of any kind, and holds no product inventory whatsoever. Title and risk of loss pass directly from the Manufacturer to the buyer in accordance with the Manufacturer’s shipping terms and at no point vest in Chow420; Chow420 is not a shipper, carrier, bailee, warehouseman, or consignee of any product.

2A. Chow420-Operated Storefronts

Certain storefronts or seller accounts on the Site may be operated by Chow420 itself. For any such storefront, Chow420 acts solely as a drop-ship reseller: products remain manufactured, packaged, labeled, and shipped directly to the buyer by the third-party Manufacturer, and Chow420 never takes physical possession of, handles, inspects, alters, or ships the product. The fact that a listing appears under a Chow420-operated storefront does not make Chow420 the manufacturer of that product, and all manufacturer-level responsibility and liability described in this Addendum — including product safety, quality, defects, labeling, recalls, and insurance — remains solely and exclusively with the Manufacturer identified for that product. All provisions of this Addendum apply with equal force to products purchased through Chow420-operated storefronts.

3. All Product Liability Rests Exclusively with the Manufacturer

Because Chow420 never manufactures, possesses, or handles the products sold through the Site, to the maximum extent permitted by applicable law, all product-related liability and responsibility rests solely and exclusively with the Manufacturer — not with Chow420, in any capacity whatsoever — including, without limitation, liability and responsibility for: product safety, quality, purity, potency, ingredients, contaminants, allergens, defects (whether in design, manufacture, or warning), labeling accuracy, marketing claims, dosage instructions, child-resistant packaging, batch consistency, shelf life, adverse reactions, side effects, personal injury, property damage, and product recalls. Any claim of any kind arising from or relating to a product — including personal injury, wrongful death, property damage, product liability (strict or otherwise), breach of warranty (express or implied), negligence, misrepresentation, or failure to warn — must be brought directly and exclusively against the Manufacturer of that product, and you expressly agree not to name Chow420 as a defendant or respondent in any such claim.

4. Insurance — Manufacturers Are Fully Responsible; Chow420 Is Not

Insurance for the products sold on the Site is the sole and full responsibility of the Manufacturer — the entity that manufactures the product — not Chow420. Manufacturers are responsible for obtaining and maintaining their own product liability and related insurance covering the products they manufacture and ship. Chow420, which manufactures nothing, does not provide, maintain, insure, underwrite, guarantee, or act as surety for any product coverage of any kind, and no insurance policy held by Chow420 extends to, names, or is available for product-related claims, losses, or recalls. Buyers seeking recovery for a product-related loss must look exclusively to the Manufacturer and the Manufacturer’s insurer, not to Chow420.

5. Recalls & Safety Notices

Manufacturers are solely responsible for initiating, administering, and funding any product recall, market withdrawal, or safety notice. If Chow420 becomes aware of a recall affecting a listed product, it may, in its discretion and as a courtesy only, delist the product and/or forward the Manufacturer’s notice to affected buyers. Doing so does not create any duty, assumption of responsibility, or liability on the part of Chow420.

6. Compliance Allocation — Federal Only; Chow420 Is Not Responsible for State or Local Compliance

The only compliance standard Chow420 enforces and covers is federal-level hemp compliance. As a condition of listing, every product offered on the Site must qualify as “hemp” under the Agriculture Improvement Act of 2018 (the “2018 Farm Bill”), 7 U.S.C. § 1639o, meaning a delta-9 tetrahydrocannabinol (Δ9-THC) concentration of not more than 0.3% on a dry-weight basis, as evidenced by a Certificate of Analysis (COA) from a third-party laboratory supplied by the Manufacturer. Chow420 reviews Manufacturer-supplied COAs and federal-compliance indicators at the time of listing and reserves the right to delist any product that fails, or ceases, to meet this standard.

Chow420 is not responsible for state, county, or municipal compliance. To assist buyers in discharging their own due-diligence duty, Chow420 provides — free of charge — multiple ChowIndex-powered compliance tools, including the 50-state interactive compliance calculator, the per-product Compliance Calculator, the per-state hemp law pages at /hempstatelaws, the 2018 Farm Bill federal-compliance indicator, and related badges and verdicts (see the Compliance Tools & Buyer Due-Diligence Addendum above). These tools are informational aids only; using them does not shift any state or local compliance responsibility from the buyer to Chow420, and any inaccuracy in the tools does not create liability for Chow420.

7. Scope and Limits of the Federal Commitment

Chow420’s federal-compliance review is a good-faith listing standard, not a warranty or guarantee. Chow420 relies on COAs and representations supplied by Manufacturers and laboratories and does not independently re-test products; Manufacturers remain solely liable for the accuracy of their COAs and the actual federal compliance of their products. Chow420’s federal-compliance commitment does not extend to state, county, or municipal law, which varies by jurisdiction and remains the buyer’s sole responsibility under the Compliance Tools & Buyer Due-Diligence Addendum above. A federal-compliance indicator on a product page is not a representation that the product is lawful in any particular state or locality.

7A. Summary of Allocation of Responsibility

  • Product liability, safety, quality, recalls: Manufacturer (the entity that makes the product) — exclusively; never Chow420, including for products sold through Chow420-operated storefronts.
  • Product insurance: Manufacturer — exclusively and fully; Chow420 carries none for products.
  • Federal hemp compliance (2018 Farm Bill): Chow420 enforces at listing, based on Manufacturer-supplied COAs; Manufacturers remain liable for actual compliance.
  • State, county, and municipal compliance: Buyer — exclusively, aided by the free ChowIndex compliance tools provided for informational purposes.

8. Indemnification by Buyers

In addition to any other indemnity in these Terms, you agree to defend, indemnify, and hold harmless Chow420, its affiliates, officers, directors, employees, and agents from and against any and all claims, demands, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to (a) any product manufactured or shipped by a Manufacturer, to the extent such claims should properly be directed to the Manufacturer under this Addendum, and (b) any state, county, or municipal compliance matter that is the buyer’s responsibility under Section 6 and the Compliance Tools & Buyer Due-Diligence Addendum.

9. Savings Clause; Order of Precedence

Nothing in this Addendum limits any liability that cannot be limited under applicable law, including any non-waivable consumer-protection rights. If any provision of this Addendum is held unenforceable, it shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force. In the event of any conflict between this Addendum and the body of the Terms above, this Addendum controls with respect to Chow420’s marketplace role, fulfillment model, product liability allocation, insurance allocation, and federal-compliance commitments described herein.

General Provisions & Dispute Resolution Addendum

Addendum effective: 05 Aug 2026. This addendum is incorporated into and made a part of these Terms.

1. Definitions — One Responsible Party

As used anywhere in these Terms, the words “Vendor,” “Seller,” “brand,” and “Manufacturer” all refer to the same party: the independent third party that manufactures, lists, and ships the product. All allocations of liability, insurance, and responsibility to any of those terms apply equally to all of them.

2. Binding Arbitration — Procedures

Except for disputes that qualify for small-claims court or concern intellectual-property enforcement, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Compliance Tools, the Rewards Program, or any purchase made through the Site shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules then in effect. The arbitration shall be conducted by a single arbitrator, seated in the State of Delaware (or, at your election, conducted remotely by videoconference or on documents alone), in English, applying Delaware law. Judgment on the award may be entered in any court of competent jurisdiction. The arbitrator — not any court — has exclusive authority to resolve any dispute about the interpretation, applicability, or enforceability of this arbitration agreement, except that a court shall decide any question regarding the validity of the class-action waiver below. Each party bears its own attorneys’ fees except where the applicable rules or law provide otherwise. If the AAA is unavailable, the parties shall select a comparable consumer-arbitration administrator.

3. Class Action and Jury Trial Waiver

You and Chow420 each waive the right to a trial by jury and the right to participate in a class action. All disputes must be brought in the parties’ individual capacities, and not as a plaintiff or class member in any purported class, collective, consolidated, private-attorney-general, or representative proceeding. The arbitrator may not consolidate more than one person’s claims. If this class-action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, and the waiver shall remain enforceable as to all other claims.

4. 30-Day Arbitration Opt-Out

You may opt out of the arbitration agreement in Section 2 (but not the class-action waiver, to the extent permitted by law) by emailing [email protected] with the subject line “Arbitration Opt-Out,” your name, and the email associated with your account, within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.

5. Informal Resolution First

Before initiating arbitration, the complaining party must send a written description of the dispute to [email protected] (or, if sent by Chow420, to your account email) and allow 30 days for good-faith informal resolution. Any applicable statute of limitations is tolled during this period.

6. Prohibited Uses

You agree not to, and not to assist any third party to:

  • Purchase products for resale, export, or delivery into any jurisdiction where they are unlawful, or on behalf of any person under 21;
  • Misrepresent your age, identity, or delivery address, or circumvent the age gate or any Compliance Tool;
  • Scrape, harvest, or mass-download Site content, listings, COAs, ChowIndex data, or pricing, or use them to train machine-learning models, without written permission;
  • Interfere with the Site’s security or operation, probe or test vulnerabilities, or introduce malicious code;
  • Post false reviews, manipulate rewards, referral, cashback, or trivia programs, or create multiple accounts to obtain credits;
  • Use the Site for any unlawful purpose or in violation of any applicable law or regulation.

Chow420 may suspend or terminate any account, cancel any order, and void any rewards balance involved in a violation of this Section, without notice or refund of promotional credits.

7. Rewards, Wallet & Promotional Credits (ChowCash)

Chow420 may offer promotional credits, cashback, referral bonuses, trivia winnings, registration credits, and wallet balances (collectively, “ChowCash”). ChowCash: (a) is a promotional discount instrument, not money, a deposit, a stored-value account, or a gift card; (b) has no cash value, is non-transferable, and is not redeemable for cash except where required by law; (c) may be subject to minimums, caps, expiration dates, and program rules displayed on the Site, which may be modified or discontinued prospectively at any time; and (d) may be revoked where obtained through fraud, abuse, error, or violation of these Terms. Chow420’s good-faith determination of ChowCash balances and eligibility is final, subject to Section 5 (Informal Resolution) and Section 2 (Arbitration).

8. User Content & Reviews

By submitting reviews, ratings, questions, images, or other content to the Site (“User Content”), you grant Chow420 a worldwide, non-exclusive, royalty-free, perpetual, sublicensable license to use, reproduce, display, adapt, and distribute that content in connection with the Site and Chow420’s marketing. You represent that your User Content is truthful, based on genuine experience, lawful, and does not infringe any third-party rights. Chow420 may moderate, edit for format, or remove User Content at its discretion. User Content does not reflect Chow420’s views, and Chow420 is not liable for it.

9. Termination

Chow420 may suspend or terminate your account or access to the Site at any time for violation of these Terms, suspected fraud, legal or regulatory requirements, or risk to the platform or other users. You may stop using the Site and request account deletion at any time. Sections of these Terms that by their nature should survive termination — including liability allocations, indemnities, disclaimers, arbitration, and the class-action waiver — survive.

10. Force Majeure

Chow420 is not liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, epidemics, labor disputes, carrier failures, utility or internet outages, cyber-attacks, governmental or regulatory actions (including changes in hemp or cannabinoid law), or Manufacturer supply failures.

11. Assignment; No Third-Party Beneficiaries; Waiver

You may not assign or transfer these Terms or your account. Chow420 may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets. Except for the indemnified parties expressly named herein, these Terms create no third-party beneficiary rights. Chow420’s failure to enforce any provision is not a waiver of its right to do so later.

12. Entire Agreement

These Terms — together with the Privacy Policy, the Shipping, Refund, and Cancellation Policy, the Compliance Tools & Buyer Due-Diligence Addendum, the Marketplace Role, Direct Fulfillment & Federal Compliance Addendum, and this General Provisions Addendum, each of which is incorporated by reference — constitute the entire agreement between you and Chow420 regarding the Site and supersede all prior or contemporaneous understandings. If any provision is held invalid, the remainder remains in full force, and the invalid provision shall be enforced to the maximum extent permissible.
