Seller Policy

1. Overview

Chow420.com provides a platform and marketplace for selling wellness and hemp-derived products. Sellers must adhere to all applicable laws, maintain transparency, and meet customer service standards. Non-compliance may result in account suspension, termination, or other actions at Chow420’s discretion.

2. Seller Enrollment

To sell on Chow420.com, you must:

  • Complete the registration process by providing accurate and complete business information, including your legal name, business details, contact information, tax documentation, and other required details.
  • Agree to comply with Chow420’s Privacy Policy and Terms & Conditions regarding the handling of personal and business data.

Only individuals or entities legally permitted to enter binding agreements under Delaware law may register as sellers.

3. Permissible and Prohibited Products

Permissible Products

  • Products must contain hemp-derived ingredients, including full-spectrum or broad-spectrum hemp extract, with a total delta-9 THC concentration of no more than 0.3% on a dry-weight basis, unless otherwise permitted by applicable law.
  • Products must comply with all federal, state, and local labeling, testing, packaging, and safety regulations.
  • All products must be accompanied by valid Certificates of Analysis (COAs) from accredited third-party laboratories upon request.

Prohibited Products

  • Products exceeding federally or state-mandated THC limits.
  • Synthetic cannabinoids, controlled substances, or unlawful derivatives.
  • Non-hemp products or those misrepresented as hemp-derived.
  • Products making unsubstantiated medical or therapeutic claims.

Chow420.com reserves the right to remove any non-compliant listings, request additional documentation, or suspend accounts violating these standards.

4. Seller Responsibilities

A. Regulatory Compliance and Labeling

Sellers are responsible for ensuring that:

  • Products comply with all applicable federal, state, and local laws and regulations.
  • Labels accurately disclose ingredients, cannabinoid concentrations, dosage information, warnings, and allergen notices.
  • All claims, promotional materials, and product descriptions are truthful, verifiable, and not misleading.

B. Intellectual Property Compliance

Sellers must respect intellectual property rights and ensure that product listings do not infringe any trademarks, copyrights, patents, or trade secrets.

C. Customer Service

  • Respond promptly and professionally to customer inquiries.
  • Provide accurate and complete information about products.
  • Maintain high service standards to promote trust and satisfaction.

5. Shipping Policies

A. Age-Restricted Products

Sellers must verify the age of buyers for age-restricted products and use shipping methods that require adult signature confirmation where required by law.

B. Restricted States and Jurisdictions

Sellers must not ship products to states, territories, or jurisdictions where hemp-derived products are prohibited or restricted. It is the seller’s responsibility to monitor and comply with changing laws.

C. Shipping Responsibility

Sellers are responsible for timely order fulfillment, accurate tracking, and proper packaging. Repeated delays, errors, or delivery failures may result in account limitations.

6. Fees & Payments

Chow420.com charges a 37% total platform fee on all completed sales, which includes:

  • A 10% risk and dispute protection fee to cover potential chargebacks, product disputes, refunds, and compliance-related costs.

Payment Process

  • Sellers may withdraw available funds once their balance exceeds $50.00.
  • Payouts are processed through Chow420.com’s secure payment systems and deposited into the seller’s designated financial account.
  • Processing times may vary based on banking institutions, compliance reviews, and fraud prevention measures.

7. Product Reviews

Buyers may leave reviews, including star ratings and photographs, on delivered products. Sellers may respond to reviews in a professional manner but must not:

  • Disclose private or confidential information.
  • Post obscene, defamatory, false, or misleading responses.
  • Engage in review manipulation, incentivization, or false endorsements.

Chow420.com reserves the right to remove reviews or responses that violate this Policy or applicable laws.

8. Seller Account Management

Chow420.com may limit, suspend, or terminate a seller’s account if:

  • Listings violate this Policy, the Terms & Conditions, or applicable regulations.
  • There is evidence of fraudulent, deceptive, or illegal activity.
  • Repeated buyer disputes, chargebacks, or complaints indicate poor performance.

Sellers will generally receive notice of enforcement actions unless restricted by legal or regulatory requirements.

9. Termination

By Seller

Sellers may terminate their account at any time by notifying Chow420 at [email protected].

Chow420.com may suspend or terminate seller accounts with 30 days’ notice, or immediately in cases of:

  • Material or repeated violations of this Policy.
  • Fraudulent, illegal, or harmful conduct.
  • Regulatory non-compliance or legal risk.

10. Indemnification

Sellers agree to indemnify, defend, and hold harmless Chow420.com, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or liabilities arising from:

  • Violations of laws, regulations, or industry standards.
  • Misrepresentation, mislabeling, or defective products.
  • Tax, customs, or reporting obligations.
  • Intellectual property disputes.

This Seller Policy is governed by the laws of the State of Delaware, without regard to conflict of law principles.

Product Liability, Insurance & Direct Fulfillment Addendum

Addendum effective: 05 Aug 2026. This addendum is incorporated into and made a part of this Seller Policy. By registering as a seller, maintaining a seller account, or listing any product on Chow420.com after the effective date, you (“Seller,” which includes the manufacturer, brand, or vendor of the product) accept and agree to this addendum.

1. Seller Is the Manufacturer of Record

Seller represents and warrants that it is the manufacturer of the products it lists, or is duly authorized by the manufacturer to sell them and to bind the manufacturer to this addendum. As between Seller and Chow420, Seller is, and shall be treated as, the manufacturer of record for every product Seller lists. Chow420 acts solely as an online marketplace and technology intermediary and does not manufacture, formulate, process, package, label, test, alter, possess, store, or ship any product.

1A. Chow420-Operated Storefronts; Supplying Manufacturers

Where a storefront or seller account on the platform is operated by Chow420 itself on a drop-ship basis, Chow420 is a reseller only and is not the manufacturer of any product sold through that storefront. Each third-party manufacturer or brand whose products are sourced, listed, or resold through a Chow420-operated storefront (a “Supplying Manufacturer”) is a “Seller” for all purposes of this addendum, and, by supplying products for listing or resale on the platform, accepts every obligation in this addendum — including the product liability assumption in Section 3, the mandatory insurance requirement in Section 4, the recall obligations in Section 5, the COA and federal-compliance obligations in Section 6, and the indemnities in Section 7 — with respect to the products it manufactures, regardless of which storefront the products are sold under.

2. Direct Fulfillment

Seller fulfills and ships all orders directly to buyers (or through Seller’s designated fulfillment partner). Title and risk of loss pass directly from Seller to the buyer and at no point vest in Chow420.

3. Seller Assumes All Product Liability

Seller assumes, as between Seller and Chow420, sole and exclusive responsibility and liability for its products, including, without limitation: product safety, quality, purity, potency, ingredients, contaminants, allergens, defects (in design, manufacture, or warning), labeling accuracy, marketing claims, dosage instructions, child-resistant packaging, batch consistency, shelf life, adverse reactions, side effects, personal injury, wrongful death, property damage, and product recalls. Seller acknowledges that the buyer-facing Terms & Conditions direct all product-related claims exclusively to the manufacturer, and Seller accepts that allocation and agrees to receive, respond to, and resolve such claims directly.

4. Mandatory Product Liability Insurance

Seller shall, at its own expense, obtain and maintain product liability insurance (and any other legally required coverage) covering all products Seller lists on Chow420.com, in commercially reasonable amounts for products of that type, for as long as Seller’s products are listed and for the applicable limitations period thereafter. Upon request, Seller shall provide Chow420 with a certificate of insurance evidencing such coverage. Seller acknowledges that Chow420 maintains no insurance covering Seller’s products and that insurance for the products is exclusively Seller’s responsibility. Failure to maintain required coverage is grounds for delisting or account suspension.

5. Recalls

Seller is solely responsible for initiating, administering, and funding any recall, market withdrawal, or safety notice affecting its products, and shall promptly notify Chow420 at [email protected] of any recall or material safety issue so affected listings can be removed.

6. Federal Compliance; COAs

Every product Seller lists must qualify as “hemp” under the Agriculture Improvement Act of 2018 (7 U.S.C. § 1639o), with a delta-9 THC concentration of not more than 0.3% on a dry-weight basis, evidenced by a current Certificate of Analysis (COA) from an accredited third-party laboratory. Seller is solely liable for the accuracy of its COAs and the actual federal compliance of its products. Chow420’s review of COAs at listing is a screening step only and does not shift any compliance liability to Chow420.

7. Expanded Indemnification

In addition to Section 10 (Indemnification) above, Seller agrees to defend, indemnify, and hold harmless Chow420, its affiliates, officers, directors, employees, and agents from and against any and all claims, demands, actions, losses, liabilities, damages, fines, penalties, judgments, settlements, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) Seller’s products, including any product liability, personal injury, wrongful death, property damage, breach of warranty, negligence, misrepresentation, or failure-to-warn claim; (b) any claim asserted against Chow420 that, under this addendum or the buyer-facing Terms & Conditions, should properly be directed to Seller as manufacturer; (c) Seller’s failure to maintain the insurance required by Section 4; (d) any inaccurate, falsified, or outdated COA or compliance representation; and (e) any recall or safety action involving Seller’s products. This indemnity survives termination of Seller’s account.

8. Order of Precedence

In the event of any conflict between this addendum and the body of this Seller Policy, this addendum controls with respect to product liability, insurance, fulfillment, and federal-compliance allocation. This addendum is intended to mirror, and shall be read consistently with, the Marketplace Role, Direct Fulfillment & Federal Compliance Addendum in the Terms & Conditions.
